JUSTICE DINESH KUMAR SINGH ORAL ORDER 19-10-2016 Heard learned counsels for the petitioners and the State. The petitioners being brothers of the husband of the informant are apprehending arrest in a case registered for the offences punishable under Sections 341,323,307,498A and 504/34 of the Indian Penal Code.
The basic accusation is of torture. It is alleged against petitioner no. 2 that he assaulted by giving repeated blow with knife on the neck of the informant.
It is submitted by the learned counsel for the petitioners that the thrust of accusation is against the husband of the informant. The injury report reflects two small abrasion over the right side of the neck of the informant. It is further submitted that

Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Samastipur in connection with Khanpur P.S. Case No.16 of 2016 subject to the conditions as laid down under Section 438(2) Cr.P.C.
