Petitioner seeks regular bail in connection with Hajipur Sadar P.S. Case No. 276 of 2020 registered for the offence under Section 25 (1-B) a / 26 of the Arms Act. The allegation as per the First Information Report is that a country made loaded pistol as well as 01 live cartridge of .315 bore were recovered from the possession of the petitioner. Learned counsel for the petitioner submits that petitioner has not committed any offence in the manner alleged and has falsely been implicated in this case with oblique motive and after his arrest in this case the petitioner has been remanded in 02 other cases which are mentioned in paragraph no. 3 of this

Patna High Court CR. MISC. No.40237 of 2020(3) dt.26-03-2021 2/2 petition. Learned counsel next submits that petitioner is in custody since 08.05.2020.

Having regard to the submissions made by learned counsel for the parties and taking into consideration the materials available on record and the fact that petitioner has got criminal antecedent, I am inclined to grant regular bail to the petitioner after completion of one year in custody. Accordingly, let the petitioner, above named, be released on regular bail after completion of one year in custody on furnishing bail bond of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur / court concerned in connection with Hajipur Sadar P.S. Case No. 276 of 2020.

It is made clear that at the time of furnishing bail bond all the parties shall follow the guidelines regarding social distancing.
