Petitioner apprehends arrest in a case registered for the offence punishable under Sections 392 of the IPC. Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Name of the petitioner transpired on the basis of confessional statement of the co-accused. No incriminating article has been recovered from the possession of the petitioner. Petitioner has got no criminal antecedent.

Learned counsel appearing for the State opposes the prayer for bail.

Considering the facts of the case, in the event of arrest/surrender within six weeks from today, let the petitioner,

Patna High Court CR. MISC. No.44098 of 2022(2) dt.05-12-2022 2/2 above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Darbhanga in connection with Simri P.S. Case No. 167 of 2020 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
