28-01-2022 Heard learned counsel for the parties through video conferencing.
The petitioner seeks bail in Kotwali (TilkamanjhiI) P.S. Case No. 78 of 2021, registered for the offence punishable under Section 370, 370(A), 120B of the Indian Penal Code and u/s 3, 4, 5 and 6 of Immoral Traffic (Prevention) Act, 1956. On a secret information that business of immoral traffic is taking place in the house of this petitioner, a raid was conducted and one person was found in an objectionable condition with one girl and in another room one more person was found in objectionable condition with another girl and third person, who was petitioner, was trying to flee away, but apprehended by the police party. Patna High Court CR. MISC. No.53806 of 2021(2) dt.28-01-2022 2/3 brought the victim girls for the said purpose and petitioner used to give Rs. 800/- per customer. Several objectionable items were also recovered from the house.
It is submitted on behalf of petitioner that though, as per F.I.R., there is allegation that the sex racket was going on in the house of this petitioner, but as a matter of fact, petitioner is not the owner of the house, rather landlord is Anil Kumar Sinha. In fact, both the victim girls, being major, were enjoying in the house with other two persons. So far as this petitioner is concerned, he runs an orchestra party and for hiring a room on rent, he had gone to meet Anil Kumar Sinha, where he (petitioner) alongwith other persons were apprehended. Though, petitioner has got criminal antecedent and he is accused in three more cases, but in all the cases, he is on bail. Petitioner is in custody since 02.02.2021. Investigation is complete. Learned A.P.P. for the State has opposed the bail petition.
Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class
