====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 08-08-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. Petitioner seeks regular bail in connection with Hajipur Sadar P. S. Case No. 567/2024 in a case registered for the offences punishable under Sections 103(1)/3(5) of the Bharatiya Nyaya Sanhita and Section 27 of the Arms Act.

3. As per the prosecution case, on 12.08.2024 at about 1:35 AM, when son of the informant had gone to attend nature's call, in the meantime, all the F.I.R. named accused persons, including three unknown miscreants, came on two motorcycles and made indiscriminate firing upon him as a result of which son of the informant fell on the ground and upon reaching the hospital, he was declared dead.

4. Learned counsel for the petitioner submits that

Patna High Court CR. MISC. No.43050 of 2025(2) dt.08-08-2025 2/2 petitioner is not named in the F.I.R. Name of the petitioner transpired during course of investigation on the basis of confessional statement of co-accused. He further submits that informant had identified two miscreants and though petitioner is co-villager of the informant, but informant has not identified this petitioner. Petitioner is in custody since 30.08.2024.

5. Learned A.P.P. for the State vehemently opposes the bail application.

6. Considering the aforesaid facts and circumstances of the case and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Vaishali at Hajipur in connection with Hajipur Sadar P. S. Case No. 567/2024.
