The petitioner seeks bail in Pasraha P.S. Case No. 105 of 2017 (G.R.No. 2451 of 2017) registered for the offence punishable under Section 414 of the Indian Penal Code. It has been submitted on behalf of the petitioner that the petitioner is innocent and has committed no offence. He has been falsely implicated in this case due to high handedness of the local police. Nothing has been recovered from the conscious possession of the petitioner. Petitioner is in custody since, 03.11.2017. Similarly situated co-accused namely Kundan Kumar vide order dated 11.01.2018 in Criminal Miscellaneous No. 1774 of 2018 has been granted bail by a co-ordinate bench of this Court.

No.454 of 2018(2) dt.17-01-2018 2/2 Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M., 1st Khagaria, in connection with Pasraha P.S. Case No. 105 of 2017(G.R. No. 2451 of 2017).
