JUSTICE MOHIT KUMAR SHAH ORAL ORDER 18-01-2018 Heard the learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners seek regular bail in connection with Baliya P.S. Case No. 289 of 2017 instituted for the offences under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. The allegation against the petitioners is that when they were going on the motorcycle they were apprehended by the Police and 12.32 liters of illicit liquor was recovered. The learned counsel for the petitioners submits that the petitioners are innocent. It is submitted that the petitioners have a clean antecedent and they are in custody since 11.11.2017. Considering the nature of accusation, the period of custody already undergone and the fact that the petitioners are

No.127 of 2018 (2) dt.18-01-2018 2/2 having a clean antecedent, I deem it fit and proper to enlarge the petitioners above named on regular bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-7th,Begusarai-cum-Special Judge, Bihar Prohibition & Excise Act, 2016, in connection with Baliya P.S. Case No. 289 of 2017.
