JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 09-04-2021 Heard learned counsel for the petitioner and learned APP for the State through virtual court proceedings. The petitioner seeks bail in a case registered for the offence punishable under Section 392 of the Indian Penal Code. Allegation against the petitioner alongwith other accused persons is of looting the parcel bag, cash alogwith ATM Card, driving license etc.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. He further submits that the petitioner is not named in the FIR and there is no incriminating articles has been recovered from the possession of the petitioner. On the basis of confessional statement of co-accused namely Ajeet Kumar, petitioner has been made accused in this case. Earlier dispute raised between the police and the petitioner. The FIR was

Patna High Court CR. MISC. No.1558 of 2021(3) dt.09-04-2021 2/2 lodged against the petitioner in Rajapakar P.S. Case No. 37/2020. Thereafter, the petitioner had also tried to lodged FIR against the police personnel, but the police personnel had refused to lodged FIR. Lastly, the Complaint Case No. 928/2020 was filed before the learned Magistrate. He further submits that the petitioner was arrested in Rajapakar P.S. Case No. 37/2020 and thereafter, the petitioner apprehended in another case. Learned counsel for the petitioner submit that he enclosed all the documents regarding the motorcycle as Annexure-3 Series. The petitioner is languishing in judicial custody since 07.03.2020.

Learned APP for the State opposes the prayer for bail of the petitioner.

Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each in connection with Bidupur P.S.
