2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 318(4), 337, 338, 340(2), 61(2) and 3(5) of the B.N.S..

As per prosecution case, informant, who is Revenue Officer, Mokama Circle Office, Patna, alleged that during enquiry, it was found that certificates such as caste certificate, residence certificate, E.W.S. certificate, etc., were being issued illegally by cyber cafe operator Rahul Kumar by taking money. Upon investigation, it surfaced that this petitioner facilitated the illegal issuance of certificates, as is reflected from their Whatsapp chats.

4. It is submitted by learned counsel appearing on behalf of the petitioner that petitioner is quite innocent and has committed no offence. The certificates in question are issued by the Circle Officer and petitioner has got no concern with the same. Even in the communication contained in Letter No. 534 dated 02.04.2026 about receipt of complaint, neither name of the complainant is mentioned nor the source has been disclosed. Petitioner is posted in the Circle Office and has got no concern whatsoever with co-accused Rahul Kumar. In the ordinary course of office, members of the public frequently forward documents and make calls seeking assistance. Such receipt of documents or telephone calls on mobile phones of Circle Office staff cannot be construed as establishing any nexus, association or involvement of the petitioner with co-accused person. Petitioner was initially appointed in the year 2011 and his entire service has been unblemished. Petitioner claims clean antecedents.
5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioner.
6. Considering the facts and circumstances of the case, general and omnibus nature of accusation and clean

7. Accordingly, in the event of arrest/surrender within a period of eight weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IIIrd, Barh, Patna in connection with Mokama P.S. Case No. 161 of 2026, subject to condition as laid down under Section 482(2) of the B.N.S.S..
