This is an application for bail in connection with Jamui (Town) P.S. Case No. 321 of 2017 registered for the offences punishable under Sections 147, 149, 337, 338, 307, 353, 188, 153A, 120B and other sections of the Indian Penal Code. In this case a large number of persons have been made accused and allegation is that procession was passing through on the eve of emersion of deity Durga there was brick batting which causes disturbance in the area among different communities. Submission of learned counsel for the petitioners is that there is general and omnibus allegation against the petitioners and other co-accused persons have been granted bail by co-ordinate Bench of this Court vide orders dated 19.12.2017 passed in

Patna High Court Cr.Misc. No.62721 of 2017 (2) dt.11-01-2018 2/2 Cr.Misc.No. 61761 of 2017 and vide order dated 20.12.2017 passed in Cr.Misc. No. 61770 of 2017 and petitioners are in custody for three months.

Having heard both sides and in the facts and circumstances of the case, let petitioners, above named, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Jamui, in connection with Jamui Town P.S.Case No. 321 of 2017, subject to the conditions that (1) one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned and (2) petitioners will co-operate in trial and appear in court as and when required, except on genuine ground, failing which their bail bonds shall be cancelled.
