Petitioner has earlier moved this Court twice for grant of bail in Cr. Misc. Nos. 3330 of 2017 and 3382 of 2018, which were rejected vide orders dated 20.03.2017 and 07.03.2018 respectively, as contained in Annexure-2 (series). Learned counsel appearing for the petitioner submits that the present case has already been committed to the Court of Sessions for trial, however the trial is proceeding in very slow pace. Petitioner is in custody since 14.06.2016. A report was called for from the Court below with regard to the present stage of trial, which has been received and is kept at Flag "B". Perusal of the report shows that the trial is at the stage of final argument.
Patna High Court CR. MISC. No.76198 of 2018(7) dt.24-04-2019 2/2 Considering facts and circumstances of the case and the nature of allegations, this Court is not inclined to grant the privilege of bail to the petitioner. The prayer for bail is, therefore, rejected.
However, considering the period of custody of the petitioner as also the advanced stage of trial, the trial Court is directed to expedite the trial of the case and conclude it within one month from today.
