The petitioner seeks bail in Sultanganj P.S. Case No. 74 of 2021, registered for the offence under Section 307, 302 of the Indian Penal Code and Section 27 of the Arms Act. As per the prosecution case, while the informant was sitting in his house and his nephew was playing at his darwaja, all of a sudden, the informant heard a sound of fire-arm and he came out of the house and saw that his nephew was in pool of blood and there was a hole in the head of his nephew and during course of treatment, informant's nephew died. It is submitted on behalf of petitioner that petitioner has been falsely implicated in this case due to political rivalry. Petitioner is not named in the F.I.R. and his name has surfaced after one day of lodging of F.I.R. in the re-statement of the
Patna High Court CR. MISC. No.53712 of 2021(3) dt.21-01-2022 2/2 informant. Petitioner has got clean antecedent and he is in custody since 17.04.2021. Chargesheet has been submitted. Learned A.P.P. for the State has opposed the bail petition.
Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 1st, Bhagalpur in connection with Sultanganj P.S.
