The petitioner apprehends his arrest in connection with Excise Case No. 806 of 2019 registered under Section 30(a) of the Bihar Prohibition and Excise Act. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. Nothing has been recovered from the possession of this petitioner. Further he submits that only on the statement of co-accused, the name of the petitioner has been transpired in the present case. It is also submitted in the first information report, nothing has been alleged against the petitioner and petitioner has no concern with the recovered

Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of the Additional Sessions Judge-IIcum-Special Judge, Excise Act, East Gaya in connection with Excise Case No. 806 of 2021, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
