Sri Ram Sumiran Rai, learned counsel for the petitioners submits that order rejecting prayer for anticipatory bail was passed by the learned Sessions Judge, Khagaria who is not vested with the power of SC/ST Act and, therefore, he may be permitted to withdraw this anticipatory bail so that the petitioner may file afresh petition for anticipatory bail before the Special Judge.

Prayer is allowed.

The anticipatory bail is, accordingly, disposed of as withdrawn.
