09-01-2019 Heard Sri Prakash Mahto, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, who is in custody since 07-05-2018 in Sikandra P.S. Case No. 101 of 2018 registered for offence under Sections 399, 402 of the Indian Penal Code and Sections 25(1-b)a, 26, 35 of the Arms Act, 1959, has prayed for grant of bail.
It was submitted by learned counsel for the petitioner that Sections 399 and 402 of the Indian Penal Code have ornamentally been mentioned in the F.I.R. and the petitioner in the present case was arrested on accusation of possessing of one country-made pistol with cartridge. Case No. 101 of 2018.
