JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-01-2019 This is an application for grant of anticipatory bail in connection with Salaiya P.S. Case No. 51 of 2018, disclosing offences under Section 30(a) of the Bihar Prohibition and Excise Act 2016.
Allegation is of recovery of 80 liters spirit from two co-accused persons and they said that the same is of the petitioner. Further it appears that the petitioner is accused in two other cases.
Submission of learned counsel for the petitioner is that the name of the petitioner transpired on the disclosure made by other co-accused persons. Though, he is accused in two cases, but he is on bail.
Heard learned A.P.P. also.
Having heard both sides, considering the above facts
Patna High Court Cr.Misc. No.75120 of 2018(3) dt.25-01-2019 2/2 and circumstances of the case, I am not inclined to grant anticipatory bail to the petitioner, rather he should surrender and make prayer for regular bail, which will be considered on its own merit, without being prejudice by order of this Court. Accordingly, this application is dismissed.
