JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-09-2019 Petitioner seeks bail in anticipation of his arrest in connection with Complaint Case No. 1254 of 2018 instituted for the offence punishable under Section 498A of the Indian Penal Code.

There is allegation against the petitioner, who happens to be husband of the complainant, of demand of dowry and subjecting her to torture.

Submission of learned counsel for the petitioner is that the allegation is false and concocted and he is still ready to keep her with dignity and care.

Heard learned APP and learned counsel for opposite party No.2, who has opposed the prayer on the ground that

Patna High Court CR. MISC. No.41207 of 2019(5) dt.05-09-2019 2/2 petitioner has performed second marriage, which has been denied by the petitioner. On query also learned counsel for opposite party No.2 could not produce any paper or state specific assertion to show that petitioner has performed second marriage.

In view of above facts and circumstances, the provisional bail granted to the petitioner by order dated 4.7.2019 is confirmed and this application is allowed. (Vinod Kumar Sinha, J) spal/- U T
