Mr.Atul Chandra, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 22-06-2022 Heard learned counsel for the petitioner no.2 and learned A.P.P. for the State.

The petitioner no.2 apprehends his arrest in a case registered for the offences punishable under Sections 302 and 201 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and the informant alleges that on account of matrimonial dispute, she alongwith her children was staying with her parents for the last 5-6 years, it is next alleged that her father-in-law had taken away her

Patna High Court CR. MISC. No.53866 of 2021(4) dt.22-06-2022 2/3 minor daughter on the pretext of cutting paddy crop, further it is alleged that after sometimes the informant came to know that her daughter has been killed.

Learned counsel for the petitioner submits that the petitioner is not related to the informant, he is a co-villager and he was completely unaware that under what circumstances the daughter of the informant died, it is next submitted that allegation against the petitioner is only of participating in the funeral of the deceased. Learned counsel further submits that being a villager, the petitioner had participated in the funeral when he had admittedly no role to play in the death of the deceased.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner no.2, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Karai Parsurai P.S. Case No. 141 of
