The petitioner apprehends his arrest in Chakia P.S. Case No. 127 of 2016 instituted for the offence under Sections 272, 273 and 290 of the Indian Penal Code and Section 47A of the Excise Act.
It has been submitted that other co-accused Vinod Chaudhary and Umesh Chaudhary with similar allegation have been granted anticipatory bail by Co-ordinate Bench of this Court vide Cr. Misc. No. 37527 of 2016 dated 17.09.2016. It is alleged that two litres of toddy has been recovered from shop of this petitioner. The petitioner was not
Patna High Court Cr.Misc. No.54877 of 2016 (5) dt.13-02-2017 2/2 found on the spot. It is mentioned in para-3 of bail petition that petitioner has no criminal antecedent. In the circumstances, prayer of the petitioner for anticipatory bail is allowed. In the event of surrender/arrest of the petitioner, named above, within six weeks from today in connection with Chakia P.S. Case No. 127 of 2016, he shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-13th, East Champaran at Motihari, subject to the conditions as laid down under Section 438(2) Cr.P.C.
