The petitioner, in the present case, is seeking regular bail in connection with Haspura P.S. Case No.173 of 2017, registered for offences alleged under Sections 8-20(b)(II)a of Narcotics Control and Psychotropic Substance Act, 1985. It is submitted by learned senior counsel for the petitioner that 15 kg of Ganja has been seized from the conscious possession of one Kishore Prasad. So far as this petitioner is concerned, from his possession one mobile of Samsung company with sim of airtel has been recovered besides the cash of Rs.3500/- in his pocket. He would submit that since the petitioner has not

Patna High Court Cr.Misc. No.244 of 2018 (2) dt.12-01-2018 been found in conscious possession of the Ganja which is also otherwise less than the commercial quantity considering that the petitioner has got no criminal antecedent, he may be enlarged on bail.

Learned APP opposed the prayer for bail.

Considering the fact that the petitioner was not having in conscious possession of Ganja and has no criminal antecedent, let the petitioner, above named, be enlarged on bail on his furnishing bail bond of Rs.15,000/- (fifteen thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge(NDPS)-cum-Session Judge, Aurangabad in connection with Haspura P.S.
