JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 16-01-2018 Heard learned counsel for the petitioners, learned counsel for the State and learned counsel for the informant. The petitioners seek pre-arrest bail in connection with Ara Mufassil P. S. Case No. 214 of 2017 registered under Section 307/34 of the Indian Penal Code and 27 of the Arms Act. Regard being had to the specific allegation made against the petitioners that they opened fire causing injury to the informant, I am not inclined to grant them pre-arrest bail. Accordingly, the application for grant of pre-arrest bail is rejected.
However, in case the petitioners surrender and seek
Patna High Court Cr.Misc. No.1016 of 2018 (2) dt.16-01-2018 2/2 bail, the same shall be considered on its own merit without being prejudiced in any manner by this order.
