This application has been filed for modification of order dated 06.05.2019 passed in Criminal Misc. No. 72722 of 2018 in connection with Kajra P.S. Case No. 77 of 2017 pending in the court of J.M. Ist Class, Lakhisarai.

Learned counsel for the petitioner submits that the pre-arrest bail of the petitioner was rejected by this Court on 06.05.2019 passed in Criminal Misc. No. 72722 of 2018 with a direction to surrender before the court below within a period of four weeks and pray for regular bail, which would be considered by the trial court in accordance with law without being

Patna High Court CR. MISC. No.42335 of 2019(2) dt.29-08-2019 2/2 prejudiced by the order of this court, but due to unavoidable circumstances, petitioner could not surrender before the court below without the stipulated period.

Since the prayer for pre-arrest bail of the petitioner was rejected by this court with direction to surrender before the court below, as such, I find no reason to modified the order dated 06.05.2019. Accordingly, this modification application stands rejected.

Moreover, petitioner may surrender before the court below.
