The petitioner seeks regular bail in connection with Paroo P.S. Case No. 125 of 2017 for the offences punishable under Sections 30(a), 38, 41, 44 of the Bihar Prohibition and Excise Act, 2016.
The allegation is regarding recovery of 21 liters of illicit liquor from the house of the petitioner. The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case. It is further submitted that the is in custody since 11.9.2017. It is further stated that barring the case in which the petitioner has been remanded, bearing Paroo P.S. Case No. 57 of 1999, there are three
Patna High Court Cr.Misc. No.722 of 2018 (2) dt.18-01-2018 2/2 other cases in which the petitioner is an accused, however, the petitioner is on bail in the said three cases. Considering the nature of accusation and the period of custody already undergone, though I am inclined to grant regular bail to the petitioner, but the same is subject to furnishing bail bonds of Rs. 2,00,000/- (Two lacs) with two sureties of the like amount each to the satisfaction of learned Special Judge (Excise), Muzaffarpur in connection with Paroo P.S. Case No. 125 of 2017.
It is further directed that in case the petitioner is implicated in a similar type of case, henceforth, the present privilege of bail shall stand automatically cancelled forthwith. (Mohit Kumar Shah, J) BTiwary/- U T
