JUSTICE SANJAY PRIYA ORAL ORDER 3/ 21-02-2019 Supplementary Affidavit has been filed on behalf of the petitioner stating that besides the case referred in para 3 of the bail application, another case is also pending against the petitioner. Let it be kept with record.

Heard learned counsel for the petitioner and learned APP for the State as well as counsel for the informant. Petitioner seeks bail in Pipra Kothi P.S. Case No.110 of 2018 instituted for the offence under Section(s) 302, 120B/34 Indian Penal Code and Section 27 of the Arms Act. Counsel for the petitioner submits that petitioner is not named in the First Information Report. Police has arrested petitioner in another case i.e. Muffasil P.S. Case No.465 of 2018. Thereafter, police recorded confessional statement of the

Patna High Court Cr.Misc. No.73715 of 2018(3) dt.21-02-2019 2/2 petitioner, which finds mention in para 137 of the case diary, and remanded him in the instant case.

Counsel for the informant submits that name of the petitioner has come in the confessional statement of the petitioner recorded before police.

Petitioner is in custody since 27.06.2018.

Besides confessional statement of the petitioner, there is no other material against the petitioner.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Motihari, East Champaran, in connection with Pipra Kothi P.S.
