The petitioner seeks bail in a case registered for the offence punishable under Section 302/34 of the Indian Penal Code.
The prosecution case, in brief, is that the informant is the mother of the deceased, who alleged that his son was killed by her daughter-in-law by administering poison to him. It is submitted by learned counsel for the petitioner that no such occurrence as alleged ever took place. She is quite innocent and has been falsely implicated in this case merely on suspicion. As a matter of fact, the petitioner is the wife of the deceased and due to lock-down and loss in business, he was
Patna High Court CR. MISC. No.9311 of 2021(4) dt.22-10-2021 2/2 suffering from economic crisis and mental depression and due to this reason, the husband of the petitioner used to hang and died. The husband of the petitioner was earlier married with another lady and petitioner is the second wife of the deceased, the said marriage was performed after hiding of first marriage. The allegation levelled against the petitioner is not specific rather general and omnibus in nature. The petitioner has no criminal antecedent and has been languishing in custody since 09.07.2020.
Learned APP for the State opposed the bail petition.
Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Phulwarisharif P.S.
