Petitioner seeks bail in a case registered for the offences punishable under Sections 341,307/34 of the Indian Penal Code in which subsequently Section 302 I.P.C was also added.
According to FIR, some unknown person fired and caused death of Md. Mustkim.
Submission is that during investigation, the petitioner was suspected in this case, however, it is evident that petitioner is resident of the same village and if the petitioner would have been the perpetrator of the crime, informant who is eye witness must have disclosed name of the petitioner in the
Patna High Court CR. MISC. No.41201 of 2019(2) dt.04-07-2019 2/2 FIR. Petitioner is in custody since 11.04.2019. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Brahampura Police Station Case No.212 of 2018, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
