Petitioner, already in custody, seeks bail in connection with Bypass P.S. Case No.112 of 2016, registered under Sections 363 and 366(A) of the Indian Penal Code. Later on Section 376 of the Indian Penal Code as well as Sections 4/6 of the POCSO Act have been added.
Allegation is that the petitioner enticed away the minor daughter of the informant.
Submission of the learned counsel for the petitioner is that the age of the girl is in between 16-17 years and the boy is also of 18 years and in her statement she has stated that she
Patna High Court Cr.Misc. No.63446 of 2017 (3) dt.19-01-2018 2 /2 married and now pregnant. Subsequently again she eloped with the petitioner, police has submitted charge-sheet in this case and the petitioner is in custody since 01.09.2017. Having considered the said facts and circumstances, petitioner Shashi Kumar is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional District & Sessions Judge, Patna in connection with Bypass P.S. Case No.112 of 2016, giving rise to Special Case No.107 of 2017.
