JUSTICE BIRENDRA KUMAR ORAL ORDER 02-02-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 307/328 of the Indian Penal Code.

According to F.I.R. the petitioner was seen while he was putting some poisonous thing in the food of Anmol Kumar, the son of the informant. The occurrence took place in the school hostel and the occurrence was seen by Niranjan Kumar. Submission of the petitioner is that the mere allegation would reveal that no offence alleged is made out against the petitioner.

Learned counsel for the State submits that Niranjan

Patna High Court Cr.Misc. No.43278 of 2016 (5) dt.02-02-2017 2/2 Kumar has supported the allegation in the F.I.R. against the petitioner.

Considering the allegation, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari/Successor Court in connection with Motihari Town Police Station Case No. 466 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
