====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 24-12-2021 Heard the learned senior counsel for the petitioner and the learned APP for the State.

The petitioner seeks bail in connection with Excise Case No.625 of 2021 arising out of Arwal P. S. Case No.208 of 2021, instituted for the offences under Section 30(a) of the Bihar Prohibition and Excise Act, 2018.

The learned senior counsel for the petitioner submits that the petitioner is in custody since 27.07.2021, he is a person with clean antecedent and charge-sheet has been submitted in this case.

Allegation is of recovery of 943 litre of liquor from an ambulance.

The learned senior counsel for the petitioner submits

Patna High Court CR. MISC. No.53642 of 2021(2) dt.24-12-2021 2/2 that petitioner was not apprehended at the place of occurrence and his name was disclosed by the driver of the ambulance out of enmity and he came to be falsely implicated in the present case.

Learned A.P.P. opposes the bail application.

Considering the fact that the petitioner is in custody since 27.07.2021, he is a person with clean antecedent and charge-sheet has been submitted in this case, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.-II-cum-Special Judge, Excise, Jehanabad in connection with Excise Case No.625 of 2021 arising out of Arwal P. S. Case No.208 of 2021.

The application stands allowed.
