The petitioner seeks bail in anticipation of his arrest in connection with Rampur P. S. Case No. 329 of 2018 dated 30.08.2018 instituted for the offences under Sections 414 and 413 of the Indian Penal Code and Section 25(1-b)a/(1-A)/(1-AA)/26/35 of the Arms Act.

The prosecution of the petitioner in the instant case is on the basis of confession of an arrested co-accused person. There is no recovery from the possession of the petitioner. One of the similarly situated persons has been granted anticipatory bail by a Bench of this Court vide order

Patna High Court Cr.Misc. No.73778 of 2018(3) dt.15-01-2019 2/2 dated 06.12.2018 passed in Cr. Misc. No. 67536 of 2018. In the earlier case in which the petitioner has been made accused, there was no recovery from the petitioner and he is on bail in the aforesaid case.

Regard being had to the aforesaid facts, the petitioner, above-named, is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt / production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya in connection with Rampur P. S. Case No. 329 of 2018, subject to the conditions as laid down under Section 438 (2) Cr.P.C. (Ashutosh Kumar, J) skm/- U
