The petitioner seeks bail in connection with Roh P.S. Case No. 64 of 2017 dated 01.08.2017 instituted for the offence under Section 30(A) of the Bihar Prohibition Excise Act, 2016. The petitioner was not arrested on the spot and was only named by a co-accused who had been arrested by the police. From the possession of the co-accused, 195 litres of Indian Made Foreign Liquor was recovered.

The petitioner is in custody since 14.09.2017. Regard being had to the fact that the petitioner was not arrested at the spot and that he does not bear any criminal antecedent, this Court is inclined to grant bail to him. In the facts and circumstances, the petitioner above

Case No. 64 of 2017.
