This application for grant of anticipatory bail arise out of complaint case no. 55 of 2013, disclosing offence under Section 406 of the Indian Penal Code and under Section 138 of the Negotiable Instrument Act.

Learned counsel for the petitioner well fairly submits that the petitioner is ready to pay the due amount of Rs. 2,10,000/- to the petitioner within a reasonable time. In view of fair stand taken on behalf of the petitioner, learned counsel for the opposite party no.2 has no objection if the petitioner is granted anticipatory

In view of above, it is directed that if the petitioner appears before the court below within four weeks' from today with a receipt in token of payment of the said amount to the opposite party no.2, he shall be released on bail on furnishing of bail bond of Rs. 10,000 with two sureties to like each amount to the satisfaction of learned Chief Judicial Magistrate, Purnea, subject to the condition laid down under Section 438(2) Cr.P.C.
