The petitioner seeks bail in connection with Bhagwanpur P.S. Case No. 61/2017 dated 08.04.2017 instituted for the offences under Sections 302, 201 and 34 of the Indian Penal Code and Sections 3 and 4 of the Dowry Prohibition Act. The petitioner is the father-in-law of the deceased. The marriage of the deceased with the son of the petitioner had taken place about 15 years ago and from the reading of the F.I.R., it appears that there is no specific allegation against the petitioner. The petitioner claims to be residing separately from his son and daughter-in-law (deceased). During the course of investigation, one of the sons of the deceased has stated that the deceased always chastised the children of the house for playing outside. A day prior

Patna High Court Cr.Misc. No.55610 of 2017 (3) dt.09-01-2018 2/2 to the death of the deceased, she had scolded her son for playing outside, for which she was asked by her husband not to scold the children of the house. Later, the deceased was found hanging from the ceiling.

Learned counsel for the petitioner has submitted that the informant and others were aware of the fact that the deceased had committed suicide and had also participated in the cremation of the deceased at Basanta Ghat, Jehanabad, but for the reasons best known to the informant, the present case has been lodged. The petitioner is in custody since 26.08.2017. Considering the aforesaid facts, the petitioner above named is directed to be released on bail on his furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate III, Vaishali at Hajipur in connection with Bhagwanpur P.S. Case No. 61/2017.
