The petitioner seeks bail in K. Nagar P.S. Case No. 359 of 2018, instituted for the offence under Section(s) 341, 323, 324 and 307/34 of Indian Penal Code. Subsequently, Section 302 of the Indian Penal Code was added. It is alleged in the written report that son of the informant Md. Afroz (since deceased) had gone with petitioner and co-accused Md. Raju with Motorcycle and did not return. The informant started searching. During course of search, the informant learnt that his son was admitted in Sadar Hospital Purnea. He went there and found him in injured condition. He had sustained injuries on his mouth and head. From Sadar
Patna High Court CR. MISC. No.42269 of 2019(2) dt.12-07-2019 2/2 Hospital, he was referred to Jawaharlal Nehru Hospital for better treatment and finally he died.
Counsel for the petitioner submits that there is no eye witness to the occurrence. The only allegation against the petitioner is that deceased was last seen with the petitioner. Petitioner is in custody since 25.3.2019 having clean antecedent.
Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea, in connection with K. Nagar P.S. Case No. 359 of 2018, subject to the condition that both the bailors will be close relatives of the petitioner. (Sanjay Priya, J) S.Ali/- U T
