JUSTICE VINOD KUMAR SINHA ORAL ORDER 02-07-2019 This is an application for grant of anticipatory bail in connection with Trial No.2372 of 2018, arising out of Complaint Case No. C-359 of 2015, disclosing offences under Sections 498A & 406 of IPC.

Case is under Section 498A of IPC.

On appearance of the opposite party no. 2, the matter was referred to the Patna High Court Mediation & Reconciliation Center, vide order dated 28.03.2019. The report of Mediator is available on record at Flag "A" which disclosed that the dispute between the parties has been resolved and the terms of settlement mutually agreed upon them, which is attached with the mediator's report. Patna High Court CR. MISC. No.76367 of 2018(5) dt.02-07-2019 2/2 disclosed that the petitioner is ready to keep her with dignity and she will also co-operate with same and they will withdraw their respective cases thereafter.

Learned counsel for the opposite party no.2 has submitted that in spite of reaching to an agreement, the petitioner is not ready to take the opposite party no.2 to his house and that shows the conduct of the petitioner. The allegation is also against the petitioner for demand of dowry and ousted her from his house and he has an illicit relationship with another lady.

Having heard both sides, considering the allegation and conduct of the petitioner, I am not inclined to grant privilege of anticipatory bail to the petitioner.
