JUSTICE ARUN KUMAR ORAL ORDER 01-02-2018 Heard learned counsel for the petitioner, the learned APP for the State as well as learned counsel for the informant. Petitioner, already in custody, seeks bail in connection with Sathi P.S. Case No. 87 of 2017, registered under Sections 376, 511, 323 and 506 of the Indian Penal Code. The allegation in brief is that the petitioner, a neighbour, entered into the house of the informant and made an attempt to rape her.

Learned counsel for the petitioner contends that the petitioner is a software engineer and neighbour of the informant and she wanted to marry him, but he declined so, this false case has been lodged. The allegation is said to be taken place on

Patna High Court Cr.Misc. No.3741 of 2018 (2) dt.01-02-2018 2/2 09.06.2017, but the First Information Report has been lodged after delay of three days, i.e., on 12.06.2017. It has also been submitted on behalf of the petitioner that he has no criminal antecedent. Learned counsel appearing on behalf of the State and the informant, on the other hand, submit that the petitioner has uploaded the photographs of the informant on the Facebook and also doing chatting on Whatsapp.

Having considered the said facts and circumstances, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 7th Additional Chief Judicial Magistrate, Bettiah, West Champaran, in connection with Sathi P.S.
