Petitioner apprehends his arrest in a case registered for the offence punishable under sections 302/304B/34 of the Indian Penal Code.
Learned counsel for the petitioners submits that the petitioners are lady members of the house and there is general and omnibus allegation against them. There is no eye witness to the occurrence. Nothing incriminating has come against them in the course of investigation.
In view of the facts and circumstances of the case, in the event of arrest/surrender within six weeks from today, let both the petitioners, mentioned above, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with
Patna High Court CR. MISC. No.41573 of 2019(4) dt.16-11-2019 2/2 two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Madhubani in Sakri Police Station Case No. 156 of 2018, on the following conditions:-
(1) Petitioners shall co-operate in the trial and shall be properly represented on each and every date fixed by the Court and shall remain physically present as directed by the Court and on their absence on two consecutive dates without sufficient reason, their bail bond shall be cancelled by the Court below.
(2) If the petitioners temper with the evidence or the witnesses, in that case the prosecution will be at liberty to move for cancellation of bail.
