The petitioner has preferred this application for grant of regular bail in a case registered under sections 47(a) and 47(f) of the Excise Act.

As per the prosecution case, 60 litres of liquor was recovered from a portion of the house of the petitioner while the accused managed to escape.

It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from his possession or his house. The petitioner was not caught at the place of occurrence. He is in custody since 27.1.2021 and chargesheet has been submitted in the case.

The application for bail is opposed by learned APP for

Patna High Court CR. MISC. No.54955 of 2021(2) dt.05-04-2022 2/2 the State who submits that the petitioner absconded for more than six years.

Having heard learned counsel for the parties and taking into consideration the facts of the case, the petitioner having remained in custody for more than 1 year and chargesheet having been submitted in the case, the petitioner is directed to be enlarged on bail in connection with Excise Case no. 3C3 of 2015 (Special B.A. (Excise) no. 618 of 2021) on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional & District Sessions Judge 2nd - cum - Special Judge, Excise, Khagaria.
