KUMAR ORAL ORDER 16-09-2019 This case has been brought under the heading 'To Be Mentioned' at the instance of learned counsel for the respondent, to recall the order dated 02.08.2019 passed by this Court, for the reason that Division Bench has directed to treat M.A as First Appeal and there was no direction to convert M.A. into First Appeal.

I am not inclined to recall the order dated 02.08.2019, as similar order has been passed by this Court as well as coordinate benches for conversion of miscellaneous appeal into First Appeal in pursuance of judgment and order passed by Division Bench in the case of Kusheshwar Purbe Vs. Shri Shri 108 Ram Janaki Jee and Ors since reported in 2017(3) PLJR 791.

Patna High Court MA No.88 of 2014(25) dt.16-09-2019 2/2 Learned counsel for the appellant is directed to convert this miscellaneous appeal into First Appeal within four weeks.
