Mr. Ram Priya Sharan Singh, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 05-08-2021 Heard Mr. Manoj Kumar Pandey, the learned Advocate for the petitioner and the learned APP for the State.

The petitioner seeks bail in anticipation of her arrest in connection with Jakkanpur P.S. Case No. 360 of 2020, dated 11.07.2020, instituted for the offences under Sections 363 and 366(A)/34 of the Indian Penal Code. It has been alleged in the F.I.R. that one Rocky Kumar along with his mother (the petitioner) came to the house of the informant and took away her daughter, namely, Suman Kumari.

The learned counsel for the petitioner has

Patna High Court CR. MISC. No.4938 of 2021(2) dt.05-08-2021 2/2 submitted that an absolutely false case has been lodged against her. The victim girl has given a statement under Section 164 Cr.P.C. in which she has disclosed that because she got angry with her mother, she came out of her house. She has very specifically said in her statement that nobody had kidnapped her.

Regard being had to the afore-noted statement of the victim girl, the petitioner above-named, in the event of her arrest or surrender before the learned Court below within a period of eight weeks, is directed to be released on bail on her furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Judge-XIV-cumA.C.J.M., Patna in connection with Jakkanpur P.S. Case No. 360 of 2020, subject to the conditions laid down under Section 438(2) of the Cr.P.C.

The application stands allowed.
