JUSTICE ARUN KUMAR ORAL ORDER 17-01-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Saharsa (Sadar) P.S.Case No. 253 of 2017 registered under Sections 342, 363, 366A, 379, 427/34 of the Indian penal Code. Submission is that informant is stranger to the petitioner and in her statement she has not made any allegation of any sexual abuse by the petitioner and it is alleged that she was handed over by the police by a lady, but her statement is not recorded by the police and the petitioner, having clean antecedent, has been in custody since 01.04.2017.

Having considered the aforesaid facts and circumstances, the petitioner, namely, Md. Firoz @ Firoz is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Mr.

Patna High Court Cr.Misc. No.57132 of 2017 (3) dt.17-01-2018 2/2 R.M.Tripathi, learned 1st Additional District Judge-cum-Special Judge, POCSO Act, Saharsa in connection with Saharsa (Sadar) P.S.Case No. 253 of 2017 (POCSO Case No. 08 of 2017), with condition that one of the bailor must be his close family relative. Petitioner shall remain physically present on each and every date during trial and in case of failure on two consecutive dates without any medical emergency, his bail bond shall be liable to be cancelled.
