2. The petitioner is in custody in connection with Chhatauni P.S Case No. 336 of 2020 from the Court of learned Additional Sessions Judge-III, East Champaran, Motihari registered for the offences punishable under Section 341, 323, 324, 307, 34 of the I.P.C.
3. As per allegation in the FIR, petitioner along with co-accused have assaulted the informant by knife, due to which informant suffered injuries.
4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. Petitioner has not received injury but he has obtained a medical report

No.43738 of 2025(4) dt.08-10-2025 2/3 from the private hospital by showing that injuries is grievous in nature but did not give detail about the injury received in which part of the body. Co-accused have already granted anticipatory bail by the Co-ordinate Bench of this Court vide order dated 27.05.2025 in Cr. Misc. No. 38240 of 2025. It is also submitted that petitioner is in judicial custody since 18.03.2025 and petitioner has got seven criminal antecedent as stated in para 3 of the bail petition.
5. However, learned APP for the State oppose the prayer for regular bail of the petitioner.
6. On perusal of the FIR, Case diary and impugned order it appears that, there is specific allegation against the petitioner assaulted on the back of the injuredcum-informant. During medical treatment Doctor has found stab wound on the back of the injured. Witnesses have also supported the prosecution case. There is total seven criminal antecedents against the petitioner and several of them are related to Arms Act, attempt to murder and other offences. Petitioner is under custody since 18.03.2025
7. Considering the aforesaid facts and circumstances of the case this Court is not inclined to grant
Patna High Court CR. MISC. No.43738 of 2025(4) dt.08-10-2025 3/3 bail to the petitioner. Hence, prayer for regular bail of the petitioner is hereby rejected. However, after completion of period of one year of custody petitioner is at liberty to renew his prayer for bail before the Trail Court. (Ramesh Chand Malviya, J) Mayank/- U T
