The petitioner seeks pre-arrest bail in connection with Simri P.S. Case No. 125 of 2017 for the offences alleged under Sections 498A, 494 and 120B of the Indian Penal Code. A joint petition supported with affidavit has been filed on behalf of the petitioner and opposite party no. 2. Learned counsel appearing for the petitioner and opposite party no. 2 submits that petitioner and opposite party no. 2, who are husband and wife, have settled their dispute out of the Court, as detailed in the petition filed today. Learned counsel appearing for opposite party no. 2 submits that opposite party no. 2 has no objection in allowing
Patna High Court CR. MISC. No.74189 of 2018(7) dt.18-07-2019 2/2 the pre-arrest bail to the petitioner as per the terms of the agreement.
Having regard to the facts and circumstances of the case, let the petitioner, above named, in the event of surrender/arrest, within a period of four weeks from today, in connection with Simri P.S. Case No. 125 of 2017 shall be released on pre-arrest bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Darbhanga, or the successor Court subject to the conditions as laid down under Section 438(2) Criminal Procedure Code.
