JUSTICE ARUN KUMAR ORAL ORDER 16-02-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Rajgir PS Case No. 236 of 2017 registered under Sections 461 and 379 of the IPC. The allegation in brief is that suspicion is raised against the petitioner of committing theft for the reason that he was found moving nearby shop of the informant.

Learned Counsel for the petitioner submits that except suspicion raised by the informant there is nothing against the petitioner, no incriminating article was recovered from his possession, he is employed in Municipality, charge-sheet has been submitted and the petitioner has no criminal antecedent. Having considered the said facts and circumstances, the petitioner, namely, Vicki @ Bahira Dome @ Bahira @ Vicky Dome is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM Nalanda at Biharsharif in connection with Rajgir PS Case No. 236 of 2017.
