The petitioner seeks bail in a case registered for the offence punishable under Sections 304B/34 of the Indian Penal Code.
Earlier, prayer for bail of the petitioner was rejected vide order dated 04.07.2019 passed in Cr. Misc. No. 18512 of 2019.
In pursuance to the order dated 22.09.2021, status report of trial in connection with Halsi P.S. Case No. 112 of 2017 has been received and kept at Flag-A, in which it is reported that out of eight witnesses, six have been examined and rest witnesses have not been produced due to lock-down. This case is fixed for evidence on 01.11.2021 and trial may be concluded within a period of three months.
Considering the present stage of the trial, I am not
Patna High Court CR. MISC. No.54473 of 2021(3) dt.27-10-2021 2/2 inclined to enlarge the petitioner on bail. Accordingly, his payer for bail is rejected in connection with Halsi P.S. Case No. 112 of 2017 pending before the court of the learned Sessions Judge, Lakhisarai.
Accordingly, the application is dismissed. However, Trial Court is directed to conclude the trial as expeditiously as possible within a period of three months from the date of initiation of normal physical proceeding and /or through Video Conferencing and S. S.P., Lakhisarai is directed to ensure production of the witnesses in the case on each and every date fixed without fail.
