JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-01-2018 Earlier prayer for bail of the petitioners was dismissed vide order dated 18.09.2017 passed in Cr. Misc. No. 41519 of 2017, with observation that petitioners may renew their prayer for bail after framing of charge in this case.

Submission of learned counsel for the petitioners that now charge has been framed and there was no direct allegation against the petitioners. Further they have no criminal antecedents and have been in judicial custody since 21.07.2017 and are ready to abide by any condition imposed on them for grant of bail. Heard learned A.P.P. also.

Having heard both sides, in view of the above facts as well as in view of the order d dated 18.09.2017 passed in Cr. Misc. No. 41519 of 2017, let the petitioners above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five

Patna High Court Cr.Misc. No.2314 of 2018 (2) dt.17-01-2018 2/2 Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge -III, Purnea, in connection with Dhamdaha P.S. Case No. 38 of 2017, subject to the following conditions:- (i) One of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.

(ii) The petitioners will not induce any witness or tamper with the evidence.

(iii) The petitioners shall cooperate in the disposal of trial and make themselves available as and when required by the court and on the event of failure on their part to appear before the court below on two consecutive dates without showing any genuine reasons, the prosecution will be free to move for cancellation of their bail bonds.
