Petitioners apprehend their arrest in a case registered for the offence punishable under Sections 376/420/34 and other allied sections of the Indian Penal Code.

Learned counsel appearing for the petitioners submits that the petitioners are innocent and have falsely been implicated in this case. He submits that the specific allegation of committing sexual assault on the victim is against Rajesh Kumar Mahto which fact has also been supported by her in her

Patna High Court CR. MISC. No.55164 of 2021(3) dt.06-07-2022 2/2 section 164 CrPC statement. Petitioner no.1 is brother, petitioner no.2 is mother, petitioner no.3 is uncle and petitioner no.4 is cousin brother of said Rajesh Kumar Mahto and they have nothing to do with the incident. .

Considering the nature of allegation against the petitioners, in the event of arrest/surrender within six weeks from today, let the petitioners, named above, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Madhubani in Madhubani Mahila Police Station Case No. 30/2021/CRI No.507 of 2021, subject to the conditions laid down under sections 438(2) of the Code of Criminal Procedure.
