2. The petitioner apprehends his arrest in a case registered for the offence under Section 302 of the Indian Penal Code.
3. As per F.I.R., the informant suspects that this petitioner, due to money dispute, has committed murder of his brother.
4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case only on suspicion. He further submits that police after investigation has submitted final form against the petitioner but differing with the same, the learned Magistrate took cognizance. In postmortem, no external or internal injury was found on the person of the deceased. Doctor has opined the cause of death due to sun stroke.

5. Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts & circumstances, let the above named petitioner, in the event of arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad, in connection with Rafiganj P.S. Case No. 266 of 2023, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure/ Section 482(2) of BNSS, 2023.
