JUSTICE ASHUTOSH KUMAR ORAL ORDER 22-12-2017 Heard the learned counsels for the petitioner and the State.
The petitioner seeks bail in connection with Jalalpur P.S. Case No. 109 of 2017 dated 02.07.2017 instituted for the offences under Sections 341, 323, 324, 325, 307, 504 and 506/34 of the Indian Penal Code.
The petitioner is said to have caught hold of the son of the informant whereupon he was assaulted by co accused Rahul, Prasun, Satyam, Shivam and others. The informant as well as his son, both, have suffered injuries at the hands of accused persons.
Learned counsel for the petitioner however has submitted that so far as the assault is concerned, it is not attributed
Patna High Court Cr.Misc. No.56337 of 2017 (4) dt.22-12-2017 2/2 to the petitioner and he is only said to have caught hold of the son of the informant. It has further been submitted that the counter case is earlier in point of time and the petitioner and others have received injuries in the occurrence for which the counter case has been lodged.
Though the son of the informant has received grievous injuries but considering the nature of accusation against the petitioner and the counter case between the parties as well as the period of custody which is from 09.10.2017, this Court is inclined to grant bail to him.
In the facts and circumstances, the petitioner above named is directed to be released on bail on his furnishing bail bond in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra in connection with Jalalpur P.S. Case No. 109 of 2017.
