Petitioner seeks regular bail in Baniyapur P.S. Case No.6 of 2017 instituted for the offence under Section 302,34 of the I.P.C..

Informant is the father of the deceased who in his fard beyan has stated that the marriage between the petitioner and his daughter was solemnized 10 years earlier and the petitioner used to reside in Delhi for employment and whole family had assembled on the occasion of marriage and on 7.1.2017 her daughter was tortured and set on fire by the petitioner and in-laws and she died due to burn injury.

It has been submitted by the petitioner that he has been

Patna High Court Cr.Misc. No.2520 of 2018 (3) dt.09-02-2018 2/2 falsely implicated in this case and has committed no offence as the allegation of torture and assault is false and concocted. The deceased wife committed suicide on trivial issue and the police found during investigation the case is not true and submitted charge sheet under Section 306 of I.P.C. He is in custody since 09.10.2017 having no criminal antecedent.

Considering the facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the A.C.J.M. XI, Saran at Chapra, in Baniyapur P.S.Case No.6 of 2017.
